Law Offices of Mark Montgomery: Initial Investigation and Pleadings

As litigation attorneys, we conduct an initial case investigation to determine where there’s enough evidence to defend a potential lawsuit or enough evidence to file a lawsuit. This investigation includes finding witnesses, taking statements, gathering documents and investigating the facts. We also engage in pre-litigation negotiations to resolve matters before filing a lawsuit. We draft a variety of motions and pleadings on behalf of the defendant or plaintiff. This includes motions to dismiss, strike, amend venue and motions for judgment.

Collin County Litigation Attorneys: Discovery, Pre-Trial and Trial

During the discovery process, we employ a variety of devices to gather information relevant to the case. These devices include depositions, interrogatories and requests for admission. In addition, we analyze information, examine physical evidence and develop a strong defense or prosecution strategy. It’s this process that allows us to identify issues and formulate the best case strategy. In the weeks before trial, we retain expert witnesses and prepare demonstrative evidence to be used as trial exhibits. It’s also not uncommon for many cases to be settled during the pre-trial phase. At settlement, we engage in negotiations, settlement conferences and create settlement agreements and releases. If the case does go to trial, we help select the jury, present opening statements, cross examine witnesses and craft a persuasive story for the judge or jury through evidence and testimony. We also help prepare jury instructions. From the get-go, we take care of everything for our clients and leave no stone unturned. You’ll also be kept in the loop.

If for any reason there isn’t a favorable outcome, we may file an appeal. At The Law Offices of Mark Montgomery are highly knowledgeable and experienced in the appellate process. You can feel confident that we will identify and preserve issues for appeal, develop appellate strategies, research procedural issues, draft appellate documents and present oral arguments before the court.
